Il est donc impossible pour lui d&rsquo;antidater un arr\u00eat de travail dans tous les cas.\u00a0<\/b><\/span><\/p>\n<p style=\"text-align: justify;\"><span class=\"sw\">Selon<\/span> <span class=\"sw\">les<\/span> <span class=\"sw\">articles<\/span> <span class=\"sw\">L.321-1,<\/span> <span class=\"sw\">D.331-1<\/span> <span class=\"sw\">et<\/span> <span class=\"sw\">D.331-2<\/span> <span class=\"sw\">du<\/span> <span class=\"sw\">code<\/span> <span class=\"sw\">de<\/span> <span class=\"sw\">la<\/span> <span class=\"sw\">s\u00e9curit\u00e9<\/span> <span class=\"sw\">sociale,<\/span> <span class=\"sw\">pour<\/span> <span class=\"sw\">qu&rsquo;un<\/span> <span class=\"sw\">patient<\/span> <span class=\"sw\">ait<\/span> <span class=\"sw\">droit<\/span> <span class=\"sw\">\u00e0<\/span> <span class=\"sw\">une<\/span> <span class=\"sw\">indemnisation,<\/span> <span class=\"sw\">le<\/span> <span class=\"sw\">m\u00e9decin<\/span> <span class=\"sw\">traitant<\/span> <span class=\"sw\">doit<\/span> <span class=\"sw\">justifier<\/span> <span class=\"sw\">de<\/span> <span class=\"sw\">l&rsquo;incapacit\u00e9<\/span> <span class=\"sw\">de<\/span> <span class=\"sw\">travail et en vertu de la Circulaire du 5-7-2001, le\u00a0<\/span>professionnel est tenu de circonscrire cet arr\u00eat de travail et <span class=\"sw\">de<\/span> <span class=\"sw\">fournir<\/span> <span class=\"sw\">d&rsquo;autres<\/span> <span class=\"sw\">informations<\/span> <span class=\"sw\">sur<\/span> <span class=\"sw\">l&rsquo;\u00e9tat<\/span> <span class=\"sw\">de<\/span> <span class=\"sw\">sant\u00e9<\/span> <span class=\"sw\">du<\/span> <span class=\"sw\">patient<\/span> <span class=\"sw\">et\u00a0<\/span>son lieu de convalescence.<\/p>\n<p style=\"text-align: justify;\"><b><span class=\"sw\">Cette<\/span> <span class=\"sw\">suspension<\/span> <span class=\"sw\">doit<\/span>\u00a0dater du jour\u00a0<span class=\"sw\">de<\/span> <span class=\"sw\">la<\/span> <span class=\"sw\">consultation.<\/span><\/b> <span class=\"sw\">En<\/span> <span class=\"sw\">effet,<\/span> <span class=\"sw\">lors<\/span> <span class=\"sw\">de<\/span> <span class=\"sw\">votre<\/span> <span class=\"sw\">rendez-vous<\/span> <span class=\"sw\">avec<\/span> <span class=\"sw\">votre<\/span> <span class=\"sw\">m\u00e9decin<\/span> <span class=\"sw\">traitant,<\/span> <span class=\"sw\">le<\/span> <span class=\"sw\">m\u00e9decin traitant vous\u00a0<\/span>interroge sur les motifs de la consultation. Le formulaire fourni par le m\u00e9decin traitant contient \u00e9galement des informations sur\u00a0les\u00a0obligations pendant\u00a0la convalescence. En effet, parfois, il n&rsquo;est pas possible de sortir, et des v\u00e9rifications peuvent \u00eatre faites par l\u2019<a href=\"https:\/\/www.mes-allocs.fr\/guides\/assurance-maladie\/comment-assurance-maladie\/\">Assurance maladie<\/a>.\u00a0<\/span><\/p>\n<p style=\"text-align: justify;\"><b>Dans le cas o\u00f9 vous n&rsquo;avez pas pu consulter un m\u00e9decin le premier jour de l&rsquo;absence, alors il faut aller voir un m\u00e9decin au plus vite afin de r\u00e9gulariser la situation. <\/b>Ainsi, vous aurez <span class=\"sw\">au<\/span> <span class=\"sw\">moins<\/span> <span class=\"sw\">une<\/span> <span class=\"sw\">justification<\/span> <span class=\"sw\">\u00e9crite<\/span> <span class=\"sw\">de<\/span> <span class=\"sw\">votre<\/span> <span class=\"sw\">arr\u00eat<\/span> <span class=\"sw\">maladie<\/span> <span class=\"sw\">\u00e0<\/span> <span class=\"sw\">compter<\/span> <span class=\"sw\">de<\/span> <span class=\"sw\">la<\/span> <span class=\"sw\">date<\/span> <span class=\"sw\">de<\/span> <span class=\"sw\">la<\/span> <span class=\"sw\">consultation.\u00a0<\/span><\/p>\n<p style=\"text-align: justify;\"><b>En revanche, concernant l&rsquo;absence injustifi\u00e9e, il faut contacter directement l&#8217;employeur et lui faire part de la situation. Lorsque le document est transmis, vous disposez de 48 heures pour le remettre \u00e0 la CPAM et \u00e0 l&#8217;employeur.<\/b><\/p>\n<p style=\"text-align: justify;\">Il faut noter que si le m\u00e9decin ne vous a remis que le volet 3 de l&rsquo;arr\u00eat de travail, <span class=\"sw\">cela<\/span> <span class=\"sw\">signifie<\/span> <span class=\"sw\">qu&rsquo;il<\/span> <span class=\"sw\">a<\/span> <span class=\"sw\">envoy\u00e9<\/span> <span class=\"sw\">lui-m\u00eame<\/span> <span class=\"sw\">les<\/span> <span class=\"sw\">parties<\/span> <span class=\"sw\">1<\/span> <span class=\"sw\">et<\/span> <span class=\"sw\">2<\/span> <span class=\"sw\">\u00e0<\/span>\u00a0la\u00a0<span class=\"sw\">CPAM. Vous devez donc remettre cette partie 3 \u00e0\u00a0l&#8217;employeur, sans\u00a0contacter\u00a0l&rsquo;organisme.<b> En revanche, si\u00a0le\u00a0m\u00e9decin\u00a0a remis\u00a0les\u00a03 parties du document, vous devez remettre vous-m\u00eame les parties 1 et 2 \u00e0 la CPAM, puis la partie 3 \u00e0\u00a0l&#8217;employeur.<\/b><\/span><\/p>\n<h2 style=\"text-align: justify;\">La prescription de l&rsquo;arr\u00eat de travail en cas de maladie<\/h2>\n<p style=\"text-align: justify;\"><b>Lorsque le m\u00e9decin <span class=\"sw\">prescrit<\/span> <span class=\"sw\">un<\/span> <span class=\"sw\">arr\u00eat<\/span> <span class=\"sw\">de<\/span> <\/b><span class=\"sw\"><b>travail, il est requis de respecter diff\u00e9rentes\u00a0r\u00e8gles.<\/b> En outre, pendant\u00a0l&rsquo;arr\u00eat maladie, vous \u00eates indemnis\u00e9 par l\u2019Assurance Maladie. <b>Ainsi, les obligations sont les suivantes :\u00a0<\/b><\/span><\/p>\n<ul>\n<li style=\"text-align: justify;\">Le respect des temps de pr\u00e9sence \u00e0 domicile : l&rsquo;arr\u00eat <span class=\"sw\">dicte<\/span> <span class=\"sw\">si<\/span> <span class=\"sw\">vous<\/span> <span class=\"sw\">avez<\/span> <span class=\"sw\">le<\/span> <span class=\"sw\">droit<\/span> <span class=\"sw\">de<\/span> <span class=\"sw\">quitter<\/span>\u00a0le logement<span class=\"sw\">,<\/span> <span class=\"sw\">et<\/span> <span class=\"sw\">si<\/span> <span class=\"sw\">oui,<\/span> <span class=\"sw\">les<\/span> <span class=\"sw\">p\u00e9riodes<\/span> <span class=\"sw\">de<\/span> <span class=\"sw\">temps<\/span> <span class=\"sw\">doivent<\/span> <span class=\"sw\">\u00eatre<\/span> <span class=\"sw\">respect\u00e9es.
